DMCA

At Lordofdot, we respect the intellectual property rights of others and expect our users and partners to do the same. This Digital Millennium Copyright Act (DMCA) Policy outlines the procedures for reporting alleged copyright infringement related to our catalog of pet accessories, beds, carriers, pet bowls, and toys. Our goal is to provide a safe and compliant marketplace for pet owners while strictly adhering to legal standards regarding creative ownership.

1. Intellectual Property Commitment

Lordofdot takes great pride in the curation of our products. Whether we are offering specialized pet carriers or ergonomically designed pet bowls, we strive to ensure that all content—including product descriptions, images, and brand identifiers—is either original, licensed, or used in accordance with fair use and digital commerce regulations.

We recognize that in the fast-paced world of e-commerce, disputes over intellectual property may arise. In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website, we have established this formal process to address claims of copyright infringement.

2. Reporting Infringement: The DMCA Notice

If you are a copyright owner or an authorized agent thereof and believe that any content on Lordofdot infringes upon your copyrights, you may submit a notification pursuant to the DMCA. To be processed effectively, your notice must be in writing and include the following information:

  • Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  • Identification of the Copyrighted Work: Clear identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works at Lordofdot are covered by a single notification, a representative list of such works must be provided.

  • Identification of the Infringing Material: Clear identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled. You must provide enough information to permit us to locate the material (e.g., the specific URL of the pet bed or toy in question).

  • Contact Information: Information reasonably sufficient to permit Lordofdot to contact you, such as an address, telephone number, and an electronic mail address (email).

  • Statement of Good Faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Submission Details

All DMCA notices should be sent to our support team for immediate review. We aim to acknowledge receipt of such notices during our standard operational hours.

  • Email: support@lordofdot.com

  • Support Hours: 8:00 AM – 7:00 PM (EST), Monday – Saturday

Please note that if you fail to comply with all the requirements of the DMCA for a valid notice, your DMCA notice may not be effective.

4. Lordofdot’s Action on Infringement Claims

Upon receipt of a valid and complete DMCA notice, Lordofdot will take the following steps:

  1. Verification: We will verify the completeness of the notice.

  2. Removal or Disabling of Access: We will expeditiously remove or disable access to the material identified as infringing (e.g., removing the image of a pet carrier or the description of a pet toy).

  3. Notification: We will take reasonable steps to notify the party responsible for the material that we have removed or disabled access to it.

  4. Repeat Infringer Policy: In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances and at our sole discretion, users or partners who are deemed to be repeat infringers.

5. Counter-Notification Procedures

If you believe that the material you posted on Lordofdot was removed (or access was disabled) by mistake or misidentification, you may file a counter-notification with us. To be effective, the counter-notification must be a written communication that includes the following:

  • Your Signature: A physical or electronic signature.

  • Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

  • Statement Under Penalty of Perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

  • Contact Details and Consent: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to the jurisdiction of the Federal District Court for any judicial district in which Lordofdot may be found), and that you will accept service of process from the person who provided the original infringement notification.

6. Consequences of Counter-Notification

If a valid counter-notification is received, Lordofdot may send a copy of the counter-notice to the original complaining party informing them that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days after receipt of the counter-notice.

7. Disclaimer and Liability

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. If you are unsure whether the material you are reporting is in fact infringing, you may wish to contact an attorney before filing a notice with us.

8. Integration with Other Policies

This DMCA Policy works in conjunction with our other store protocols:

  • Shipping & Returns: If a product is removed due to a DMCA claim, any pending orders for that specific item will be handled in accordance with our Refund Policy, with funds returned to the original payment method (PayPal or Venmo) within 7 business days.

  • Privacy: Information provided in a DMCA notice is handled as described in our Privacy Policy to the extent necessary to resolve the legal claim.
